Use of Personal Information - Privacy Policy
Under Art. 13 of Italian Legislative Decree No. 196 dated 30/06/2003

Article 13 of the “Personal information protection code” (Leg. Dec. No. 196 of 30 June 2003) requires that the interested party be informed regarding the basic use to be made of the information. The undersigned UTENSILERIA MODENESE S.R.L. complies with this requirement by informing you as follows.

Purpose

Your personal information is collected for the following purposes:

• To perform the obligations deriving from the contract in which you are a part, or to fulfil specific requests on your part prior to execution of the contract;
• To comply with legal requirements relating to civil, fiscal and accounting rules, regulations, community standards;
• To manage customers and suppliers (administration of contracts, orders, invoices, …);
• To manage any disputes (breaches of contract, legal controversies,…);
• To send advertising and/or promotional materials regarding our activity (offers, information sheets, gadgets,…).

Manner of use

With regard to the above mentioned purposes, personal information is handled on paper and using information technology and telematic devices so as to guarantee the security and confidentiality of the information, as well as full compliance with the Law. This statement is provided for the information collected directly from the interested party (art. 13, paragraph 1), from third parties (art. 13, paragraph 4) or obtained from public records, lists, deeds or documents that open to public access (art. 24, paragraph 1, letter c).

Nature of the information provided and consequences of your refusal to reply

The information provided by you is:

• Compulsory for legal and contractual requirements, so that refusal on your part to provide said information or authorise its use may result in the undersigned being unable to proceed with said contractual agreement.
• Optional for all that information not relating to legal or contractual requirements, with particular reference to the sending of advertising and/or promotional material regarding our commercial activities. As a result there will be no consequences should you refuse to provide this information, except that we will be unable to send you the above material and to implement promotional activities aimed at improving the service we provide you.

Communication

• For the purposes listed above your personal information may only be communicated, together with those individuals who are granted the power of accessing it under specific laws or secondary regulations, to the categories of individual listed below, who will use it independently: Post Office or other companies responsible for delivery of correspondence; Bodies, Companies and Institutions in the banking, credit and insurance sector; Legal offices to handle any disputes; Professional offices/companies/associations of companies/freelance professionals who provide the undersigned with certain services (accounting, fiscal, maintenance/servicing of information technology equipment,…) instrumental to the economic activity and in compliance with current regulations.
• Your personal information may also come to the knowledge of our partners and our employees and authorised assistants, insofar as they are used to carry out the purposes described above,.

Rights of the interested party

Under art. 7 of the Code you are entitled: to receive clear confirmation, free of charge, of whether or not your personal information is in our possession; to request that said information be updated, modified or completed; to obtain blockage, cancellation or transformation into an anonymous form in the event of violation of the law or if the need to use the information ceases to exist; to oppose use of the information for legitimate reasons or its use to send information and advertising material, market research, commercial notices.

Data controller

The data controller is the Company UTENSILERIA MODENESE S.R.L., with registered offices in VIA REPUBBLICA VAL TARO 220 – 41122 MODENA, in the person of its Legal Representative Mr. MAURO MASSA, who elects domicile at said address.
